Silver Dollar Ranch General Release of Liability
SILVER DOLLAR RANCH, LLC
ADULT GUEST ASSUMPTION OF RISK AND RELEASE OF LIABILITY
WARNING
Under Idaho law, there are risks associated with agritourism, which could lead to injury or death. You are assuming these risks. Section 6-3004, Idaho Code.
I confirm that I am at least 18 years old. In exchange for permission to enter property owned, leased, or operated by Silver Dollar Ranch, LLC (the “Ranch”) and participate in activities during the visit for which I submit this form, I agree as follows:
1. RISKS I ACCEPT
I understand that visiting a ranch and participating in outdoor activities can cause serious injury, illness, death, or property damage. My visit may include fishing, hunting, shooting, hiking, wildlife viewing, lodging, camping, gatherings, riding in or operating an authorized vehicle or four-wheeler, and other activities approved by the Ranch.
Risks include uneven, steep, rocky, muddy, or slippery ground; holes and obstacles; ponds, creeks, and other water; changing weather, lightning, heat, cold, and wildfire; wildlife and livestock; firearms, ammunition, arrows, and flying clay targets; vehicles and unimproved roads; campfires; buildings, fences, and equipment; and the actions of other people. Guides, instructions, and safety equipment cannot eliminate every risk. I voluntarily accept the inherent and ordinary risks of my visit, including risks I may not know or anticipate.
2. RELEASE, INCLUDING ORDINARY NEGLIGENCE
I release Silver Dollar Ranch, LLC; the legal owners of property used for Ranch activities; and their respective members, managers, employees, and agents (together, the “Released Parties”) from claims for injury, illness, death, or property damage arising from my visit or participation, to the fullest extent permitted by Idaho law.
I understand and agree that this release INCLUDES CLAIMS CAUSED IN WHOLE OR IN PART BY THE ORDINARY NEGLIGENCE OF A RELEASED PARTY. This includes ordinary negligence in maintaining property, roads, lodging, vehicles, or equipment; selecting or providing equipment; giving instructions or supervision; and organizing or conducting Ranch activities. This agreement does not release any claim that Idaho law does not permit me to release.
I intend this release to bind me and, to the extent permitted by law, my estate and legal representatives. It applies to the visit for which I submit this form and activities associated with that visit.
3. MY RESPONSIBILITIES
I will follow applicable laws, Ranch rules, posted warnings, and instructions from Ranch personnel and authorized activity leaders. I will stay in authorized areas. I will not handle or discharge a firearm, participate in shooting, or operate a vehicle or other equipment without authorization. I will not shoot or operate a vehicle while impaired by alcohol or drugs.
I am responsible for deciding whether an activity is appropriate for my health and abilities. I will tell the activity leader about any limitation that affects my safe participation. I understand that the Ranch does not guarantee that I will catch a fish, see game, or have a successful hunt.
4. DAMAGE I CAUSE
I am responsible for damage or injury caused by my negligent or intentional conduct or my violation of law or Ranch rules. To the extent permitted by law, I will reimburse the Released Parties for third-party claims and reasonable costs arising from that conduct, including a fire I negligently start or fail to control. I am not agreeing to pay for a Released Party’s own negligence.
5. EMERGENCIES
If an emergency occurs, I authorize Ranch personnel to contact emergency responders and provide information reasonably needed to request assistance. I am responsible for charges from medical providers, emergency responders, and transportation services, subject to applicable law.
6. ELECTRONIC AGREEMENT
Idaho law governs this agreement. If any provision is unenforceable, the remaining provisions will continue to apply to the extent permitted by law.
I have read this entire agreement, understand it, and agree to it voluntarily. I understand that I am giving up the right to bring certain claims, including claims based on the Ranch’s ordinary negligence. By typing my full name and date into the fields provided with this form and submitting it, I intend those entries to be my electronic signature and agreement to these terms.
